The ANP promoted the signature of the Agreements of the 15th Concession Bidding Round in two stages. The first one, date of 09/11/2018 and second in 11/07/2018. The ceremonies occurred in the JW Marriott Hotel in the city of Rio de Janeiro, located at Avenida Atlântica, No. 2.600, Copacabana, and in both occasions were present ANP Directors, the Minas and Energy Ministry, the executive secretary of the Minas and Energy and the companies representatives.
In September, 11th, 10 concession agreementes were signed by five winning bidders that requested the antecipation of the date of the signature of the agreements and opted for submitting the documents and to pay the signature bonus antecipated as well: Equinor Brasil Energia LTDA; ExxonMobil Exploração Brasil Ltda; Petróleo Brasileiro S.A; QPI Brasil Petróleo Ltda, and Shell Brasil Petróleo Ltda.
In November, 7th, were signed 12 concession agreements by 10 winning bidders: BP Energy do Brasil Ltda, Equinor Brasil Energia Ltda, ExxonMobil Exploração Ltda, Chevron Brasil Óleo e Gás Ltda; Murphy Brasil Exploração e Produção de Petróleo e Gás Ltda, Petrogal Brasil S.A, Queiroz Galvão Exploração e Produção S.A., Repsol Exploração Brasil Ltda., Shel Brasil Petróleo and Wintershall do Brasil Exploração e Produção Ltda.
In the 15th Concession Bidding Round all the 22 blocks awarded by 12 bidders had their concession agreements signed.
The ANP approved the judgment report of the 15th Round of Bids(Portuguese only) prepared by the Special Bidding Commission (CEL) and awarded the object of the bidding to the successful bidders, according to the decision published in the Official Gazette of the Union on 06/22/2018(Portuguese only).
In order to sign the concession agreements, the bidders or affiliates indicated by them must present documents and guarantees, as well as have proven the payment of the signature bonus, within the deadlines defined in Table 1 of the public bidding documents, as follows:
The documents required for signing the concession agreements are listed in Table 17 of the tender protocol and must be presented in a single via, regardless of the number of blocks sold, except for the documents described in sections 9.1.2, 9.1.3, 9.1. 4 and 9.1.5 (where applicable) which must be submitted one for each contract to be signed.
Pursuant to Section 9.2 of the tender Protocol, the winning bidder may delegate the signature of the concession agreement to an affiliate having its head office and administration in Brazil. The affiliate receiving the delegation must present documents for signing the concession agreement, provided for in sections 9.1.2, 9.1.3 and, if applicable, 9.1.4 and 9.1.5, and obtain economic, financial, legal and technical qualification in the minimum level required to sign the agreement, in addition to proving its tax and labor regularity.
