Transport of Natural Gas

The Law 11,909/2009 (the Gas Act) implemented the concession regime for the transport of natural gas. The ANP shall promote auctions for construction and operation of all transport gas pipelines considered by the government as being part of general interest.  Authorization shall be granted by ANP in particular cases. ANP shall prepare tender protocols and concession contracts and shall hold biddings for the construction or expansion and operation of gas pipelines under concession, observing the guidelines of the Ministry of Mines and Energy (MME).

The gas pipelines that must be constructed or extended shall be proposed by initiative of the MME or by provocation of third parties. The Ministry published on March 05th, 2012 the Ordinance 94* which disciplines the mechanism of provocation by third parties. 

On September 13th, 2013, the MME published in the Official Gazette Ordinance 317* which proposes the construction of a gas pipeline between the municipalities of Itaboraí and Guaipimirim, in the state of Rio de Janeiro.  Subsequently, on December 13th, it published Ordinance 450*, which establishes guidelines for the bidding of that pipeline.  As determined by this Ordinance, ANP will hold the bid, as well as the public call for tender. The public call for tender to hire transport capacity is the procedure, with secured access to all interested parties, which aims at identifying the potential carriers and sizing the effective demand, in addition to defining the maximum rates to be charged from the carriers interested in hiring the transport capacity.

The MME released, on March 26th, the Ten-Year Expansion Plan for the Gas Pipeline Transport Network (PEMAT) 2013-2022. The document, product of studies carried out by the Energy Research Company (EPE), takes into account, for the next 10 years, the expected performance for the demand for natural gas, its production and supply forecasts and the conditions of the existing infrastructure to fulfill the future demand. At the same time, it presents proposals for routing and compression systems to be installed, as well as for the location of city gates and the estimated investments in gas pipelines.
